Huntsville Slip and Fall Lawsuit Against Chili’s Settles at Mediation

Huntsville, Al personal injury lawyer Morris Lilienthal is pleased to announce he has reached a settlement arising out of a slip and fall accident at a local Chili’s Restaurant. The accident occurred when the plaintiff slipped and fell on a greasy substance on the floor resulting in the plaintiff sustaining a serious back injury. As a result of the fall, the plaintiff underwent two back surgeries, multiple injections, and several rounds of physical therapy. The plaintiff’s medical bills totaled over $300,000.

Under Alabama law, a premises owner has a duty to keep its premises in a reasonably safe condition. In the context of a slip and fall accident, the plaintiff has to establish the premises owner had actual knowledge of the foreign substance (dangerous condition) or that they had constructive notice of the foreign substance. What To Do If You Have a Slip and Fall in Alabama

Slip and Fall AccidentA slip and fall or trip and fall accident comes within an area of the law known as premises liability. Under Alabama law, a premises owner has a duty to keep their premises in a reasonably safe condition for a business invitee. The plaintiff or injured party has the burden of proof in slip and fall case to establish that the premises owner/operator knew or should have known of the dangerous condition on their property that caused the person to fall. This often is a tough burden to meet. However, this can be established in a variety of ways: 1. Does the premises owner have a policy and procedure whereby they monitor their premises; 2. If the fall was caused by a substance, was there such a large amount that they should have noticed it?; 3. If the fall was caused by a defect in the premises the premises owner is presumed to have notice and knowledge of the condition; and 4. If the defect was created by the premises owner they are presumed to have notice – i.e. leaving an object sticking out in the aisle.

Huntsville Personal Injury Lawsuit Against Hardees Settles

Our client was severely injured when she slipped and fell at Huntsville area Hardees Restaurant. As a result of matter, a personal injury lawsuit was filed in Madison County Circuit Court. This premises liability case, (slip and fall) centered on the subject steps where our client fell. Under Alabama law, a premises owner has a duty to maintain their premises in a reasonably safe condition. As a part of our case, we hired an expert witness who was of the opinion that the subject steps violated various building standards and safety codes. As a part of our client’s case, we were seeking compensation for medical bills, pain and suffering, out of pocket expenses, loss of enjoyment of life and mental anguish. After written discovery was exchanged between the parties and various depositions were taken the case was resolved for a confidential amount at mediation. 2nd Deck Accident in a Month at Hoover Apt. Complex

A second story deck collapsed this past Saturday at the Waterford Landing apartment complex in Hoover, Al. Four people suffered minor injuries as a result of the deck’s failure. This is the second time in a month a deck has collapsed at this apartment complex. On July 4th a deck collapsed at this same complex tragically killing one person and injuring 6 others. Authorities have yet to determine if this second collapse is linked to the same problem that caused the first deck to collapse. Deck Collapses in Hoover, AL Apt Complex Killing One & Injuring 6 Others

The collapse of third (3rd) story deck at the Waterford Landing Apartments located in Hoover, Alabama has tragically claimed the life of one Alabama resident and injured 6 others. The collapse happened Sunday night – July 4th – when 7 people were standing on the deck when it gave way sending the people crashing into the deck below. 25 year-old Gerald Andrew (Drew) Scribner an Iraq War Veteran was killed in the collapse.
