If you are contemplating or facing a divorce, what can you expect in the way of legal proceedings? By knowing your rights to visitation and custody in a divorce action, the process can be smoother for all parties.

While no one enters a marriage with the expectation of divorce, the reality is that about 40-50% of married couples will get divorced. If children are born of the marriage, the parents (and potentially a judge) must determine who retains custody after the marriage ends. One of the biggest questions to be addressed in a divorce is child custody. Alabama law requires that custody arrangements be made using the best interests of the child standard. In meeting this standard, the court may consider the child’s age, who has been the primary caregiver, where the kids go to school, parent-child relationships, and the children’s preference.

Morris has been assisting families and accident victims since 2003, and was recently selected as a Super Lawyers Rising Star. Morris finds his calling in helping injury victims put the pieces back together. He is also heavily involved with Team Will and the March of Dimes. He is also the host of the Mo Show Live which features local, state and national leaders.

Caleb W. Ballew joined the firm of Martinson & Beason, P.C. as an associate attorney in October 2012. Caleb’s practice areas include divorce, domestic relations, criminal defense, general civil litigation and estate litigation. In addition, he is a certified guardian ad litem and often represents the rights of juveniles.
